
General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all agreements between the association Sail to BE (hereinafter "we", "us", or "the association") and users of the website spiritofawareness.org, as well as to all participants in our events and activities (hereinafter "you", "participant", or "user").
2. Conclusion of Contract
(1) A contract for participation in an event or the use of our website is concluded once the user confirms their registration. Registration is completed via the relevant forms on our website.
(2) By registering or using our website, you agree to these GTC. Diverging terms and conditions from users will not be accepted unless expressly confirmed by us in writing.
3. Services of the Association
(1) Sail to BE is a non-profit organization dedicated to the promotion and preservation of maritime traditions and the organization of shared association activities. All events and activities offered are internal and exclusively for the association community. No commercial profit is pursued.
(2) Participation in the events is voluntary. The participation fee is a contribution to cover the actual costs of the event (e.g., materials, equipment, transport, or venue rental). The association has no commercial interests.
4. Participation Fees and Payment Terms
(1) Participation in our events requires a cost contribution, which serves to cover the association’s actual expenses. The amount of this contribution is specified in each event description on our website.
(2) Payment is generally due before the start of the event unless otherwise agreed. Payment can be made via bank transfer or through the available payment methods on the website.
5. Cancellation and Refunds
(1) Cancellations are possible up to a certain deadline before the event. Specific conditions for cancellations and refunds are detailed in the respective event listing.
(2) If you cancel after the deadline or fail to attend the event, you are not entitled to a refund, unless the event was cancelled by the association.
(3) If an event is cancelled or postponed by the association, any participation fees already paid will be fully refunded.
6. Rights and Obligations of Participants
(1) Participants are expected to take part in events actively and respectfully and to follow the instructions of event coordinators.
(2) Participation in events is at your own risk. The association is not liable for damages that occur during the event unless caused by gross negligence or intentional misconduct by the association.
(3) Each participant is responsible for informing themselves in advance about any health requirements and safety precautions.
7. Liability
(1) The association is liable only for damages caused by intent or gross negligence. Liability for simple negligence is excluded unless it concerns injury to life, body, or health.
(2) The association assumes no liability for damages or losses caused by third parties or force majeure.
8. Data Protection
(1) The association processes personal data in accordance with the privacy policy available on our website. Data is processed solely for registration purposes, communication with participants, and the organization of events.
(2) You have the right to request information about the stored data at any time and to request its deletion, provided there are no legal retention requirements.
9. Copyright
(1) All content on the website, including texts, images, logos, and graphics, is protected by copyright. Use of this content is not permitted without the express written consent of the association.
(2) You agree that photos taken during events may be used by the association for public relations and documentation purposes, unless you explicitly object.
10. Amendments to the GTC
The association reserves the right to amend these GTC at any time. Changes will be published on the website and take effect upon publication. Users are advised to review the GTC regularly for updates.
11. Final Provisions
(1) Austrian law applies. The place of jurisdiction is the registered office of the association, where legally permissible.
(2) If individual provisions of these GTC are or become invalid, the validity of the remaining provisions remains unaffected. In place of the invalid provision, a regulation shall apply that comes as close as possible to the economic intent of the invalid one.
